1. * In reserving the Property specified in this agreement a Contract of Sale will be forwarded to your Solicitor / Conveyancer for review. The Purchaser is encouraged to return the signed Contract of Sale within 7 days. Any amendments to the Contract of Sale should be directed through your conveyancer / solicitor and the vendor’s solicitor.

2. * At any time prior to the signing of a Contract of Sale, the Purchaser may end this Agreement, in which case, the Purchaser’s Holding Deposit shall be refunded in full. The Vendor acknowledges they are not entitled to any interest which accrues on the Holding Deposit which is held in trust by the Vendor.

3. * The Holding Deposit shall be applied towards the deposit payable under a fully executed Contract of Sale.

4. * I/We acknowledge that:

• The Vendor has no obligation to agree to sell a property in the Development, to me/us, and may refund the Holding Deposit to me/us in its sole discretion and at any time without being required to justify or explain such action.

• The information provided in relation to any property in the Development, including its price, is indicative only and may change at any time prior to the exchange of Contracts of Sale; and I/we may not make any objection or claim compensation relating to such a change.

• This Agreement shall be governed by the Real Estate laws.

5. Please note that the holding deposit is held in seller’s Trust Account. In the event the sale does not proceed, holding deposit refund will be processed within 30 days.
